The website https://shop.abbonamentomusei.it/ and its sub-domains, if any, are reserved for a public consisting of Consumer Users, (hereinafter also referred to as "Customer" or "Purchaser") understood as natural persons who, in connection with the purchase of Products, are acting for purposes unrelated to any entrepreneurial, commercial, handicraft or professional activity carried out.

Use of the website is restricted to customers who are at least 14 years of age. We therefore invite those who are not yet of this age not to register, and those under 18 to be assisted by their parents/guardians.

The https://shop.abbonamentomusei.it/ website is dedicated to B2C (Business-to-Consumer) sales, for which the indiscriminate collection of information through automated tools (so-called web scraping) is expressly prohibited. ASSOCIAZIONE ABBONAMENTO MUSEI reserves the right to take legal action to enforce its rights.

Under no circumstances may the Customer alter, change, modify or adapt the Site or the material made available by ASSOCIAZIONE ABBONAMENTO MUSEI  

The Abbonamento Musei website has a Reserved Area that allows users to purchase (for themselves and others), renew their subscriptions (for themselves and others), purchase gift cards, and view the QR code of their Abbonamento Musei card for validation at the ticket office (instead of the physical card), di book reserved activities, to view the history of their accesses and purchases.

The Museum Subscription area can be reached at https://shop.abbonamentomusei.it/by logging in with the credentials (email and password) of your personal account.

For those who do not have these credentials, it is necessary to make a new registration, creating your personal account directly from the APP or from the Abbonamento Musei - Reserved Area website https://shop.abbonamentomusei.it/

Registration on the site is free of charge; use of the account is reserved exclusively for the User, and may not be transferred to third parties. The User is required to keep his/her Registration Credentials confidential, and undertakes to notify ASSOCIAZIONE ABBONAMENTO MUSEI without delay if he/she suspects undue use of the same or of his/her account. The Registration Credentials may be changed by the Customer at any time within his/her reserved area or through the password recovery function.

The Customer is solely responsible for access to the Site by means of the Registration Credentials and is directly liable for any damage or prejudice caused to ASSOCIAZIONE ABBONAMENTO MUSEI or to third parties as a result of the violation of the rules deriving from the present Conditions or from the law as a result of improper use, loss, misappropriation by third parties or from the failure to protect adequate secrecy of his Registration Credentials. All transactions carried out through the account, and the Registration Credentials are deemed to be carried out by the Customer to whom they relate.

The Customer guarantees that the information provided during the registration procedure on the Site is complete, correct and true. In the event that false statements are made, ASSOCIAZIONE ABBONAMENTO MUSEI, after a formal and unaccepted invitation to self-correction, has the right to delete the account.

Only one registration per user is possible. Multiple registrations will be subject to cancellation.

CONTRACTUAL CONDITIONS

By making any purchase on the site, the recipient declares that he/she accepts these terms and conditions and that he/she abides by all the provisions governing the use of the site including, but not limited to, the conditions for orders and shipments, the privacy-policy of the website and the one concerning the Museum Subscription.

These contractual conditions are only available in the Italian language. The concluded contract will be filed through an electronic system and will be accessible to the personnel appointed by the service provider. By communicating their data to Associazione Abbonamento Musei, the recipient of the services (Customer) consents to the use by Associazione Abbonamento Musei of their first name, last name, date of birth, place of birth, sex, tax code, address of residence, shipping and billing, educational qualification, museum preferences, telephone number and e-mail address in connection with the conclusion and execution of the contract, including commercial communications based on legitimate interest on the basis of Article 6(1)(f) of EU Regulation 2016/679.

OBJECT OF THE CONTRACT AND ITS DEFINITION

A contract of sale is a legal transaction concerning movable goods and/or services concluded between a supplier, Associazione Abbonamento Musei, and a customer within the framework of a sales system organised by the supplier that, for such a contract, uses both the Internet and other means of communication such as telephone (smartphone), fax, etc. All contracts will be concluded directly by sending the order to the supplier by one of the above mentioned means of communication or by means of the website, following the procedures set out below.

  2. Product prices are indicated in the E-commerce section and are, unless otherwise stated, inclusive of VAT.
  3. The payment methods provided include: credit and debit cards. In this regard, we would like to inform you that transactions are carried out on an external payment gateway, in accordance with the security measures and policies of the operator (Axerve);
  4. products are delivered by e-mail and/or by courier service, depending on whether the products are intangible or not. In order to check the shipping status of the products you have ordered, please contact us and inform us of the order number assigned;
  5. delivery costs within the national territory (Italy) are borne by Associazione Abbonamento Musei; however, no delivery outside the national territory is possible.

  7. Where shipping is provided, products are entrusted to the courier within 5 working days of purchase. In all cases, it is always possible to use the digital version of the product provided immediately after ordering by email;
  8. According to current regulations (art. 52 of Legislative Decree 206/2005 as amended and supplemented) the Museum Subscription is refundable only if purchased online, not used and within 14 days from the purchase. To obtain a refund write to [email protected]
  9. In any other case, the Museum Pass is in no way refundable

WITHDRAWAL AND RETURNS

There is a right of withdrawal for purchases made via e-commerce, if unused, within 14 days of placing the order. Once the term of 14 (fourteen) working days from the date of issue of the goods has elapsed without the customer having communicated by email to [email protected] his wish to withdraw, the proposal shall be deemed binding on him.

In the event of withdrawal by the customer, if a delivery of goods has taken place, the customer shall destroy any media (card).

The right of withdrawal lapses in its entirety when the essential condition of integrity of the goods (use of the product) is no longer met.

If no objection is made, Associazione Abbonamento Musei shall credit the same amount received from the customer to the same payment instrument used.

OBLIGATIONS OF THE PURCHASER

The customer undertakes and is obliged, once the purchase procedure has been completed, to ensure that he/she keeps these general terms and conditions, which he/she has already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product purchased. These general terms and conditions may be updated or modified at any time by Associazione Abbonamento Musei, which will communicate them through the normal communication channels on the website.
It is strictly forbidden for the buyer to enter false and/or fictitious data in the registration procedure required to activate the process for the execution of this contract and the related further communications. In such cases, once the facts and circumstances have been ascertained, Associazione Abbonamenti Musei reserves the right to report alleged incidents to the competent Judicial Authorities.
Multiple registrations corresponding to the same person are expressly prohibited. Purchasers have a duty to keep their access credentials safe and not to disclose them. Should the purchaser suspect that their access credentials are being misused, they are obliged to notify Associazione Abbonamento Musei.

 Associazione Abbonamento Musei reserves the right to prosecute any violation and abuse. The Customer indemnifies Associazione Abbonamento Musei from any liability arising from the issuance of erroneous tax documents due to errors in the data provided by the Customer, since the Customer is solely responsible for their correct entry.

PURCHASING METHODS

The customer can purchase products in the Reserved Area of the Subscription Museums website (https://shop.abbonamentomusei.it/).

To purchase a product, once you have identified the one you are interested in, you must select the desired quantity (if compatible with the chosen product) and then place it in the shopping cart by pressing the add to cart button.

In the shopping cart you will find all the references for making your purchase, such as the product quantity, description, unit price and total price. It is also possible to add other products to the basket, cancel the order and return to the shop or fill in the billing and shipping address details. To proceed to the order confirmation phase and finally proceed with the purchase, click on the complete purchase button.

The customer will be able to choose between a credit card or debit card payment option.

Finally, by pressing the order confirmation button, the order will be transmitted and then processed, and the on-line sales contract will be deemed to have been concluded as described above; at the same time, an email will be sent confirming that the order has been taken care of, indicating the number assigned to it.

Subsequently, a further confirmation email containing the purchased products will be sent;

SHIPPING METHODS

If requested by the customer and if compatible with the chosen product, the selected and ordered products will be delivered to customers by express courier.

However, all products are delivered electronically via email. 

Any home delivery, provided for specific products, is guaranteed throughout the national territory by courier. In case of "ordinary" shipping, delivery costs are charged to Associazione Abbonamento Musei; while "express" shipping is charged, unless otherwise specified. Generally, delivery to the courier takes place 5 working days after the date of order processing. The customer assumes all responsibility for the truthfulness of the data indicated for invoicing and shipping of the purchased products.

LIABILITY

In case of evident damage, delay or non-receipt of the order, the Customer shall promptly inform Abbonamento Musei (by writing to info@ abbonametnomusei.it ) in order to know how the support can be replaced.

Similarly, Associazione Abbonamento Musei is not liable for any fraudulent or illegal use that may be made by third parties of credit cards and other means of payment when purchasing products, as it is not, at any time during the purchase process, able to know the buyer's credit card number, which is transmitted directly to the bank service provider through a secure connection.

CAUSES OF FORCE MAJEURE

Associazione Abbonamento Musei shall not be liable for any delay or non-execution of deliveries due to force majeure, and reserves the right to terminate the contract in whole or in part and/or suspend and/or postpone its execution.

PROVISION AND PROCESSING OF PERSONAL DATA

All data of the person concerned are processed in accordance with the data protection regulations, as expressly explained in the  privacy-policy of the site, which, moreover, the Customer confirms having already viewed and accepted. In addition to what is indicated in the information notice pursuant to Reg.(EU) 2016/679 -GDPR- and Legislative Decree 196/03 as amended and supplemented, set out in the aforementioned  privacy-policy, which is recalled in its entirety and in particular the E-commerce and Payments section, the data is processed electronically in compliance with the laws in force and may be produced only at the request of the competent judicial authority or other authorities authorised by law. Personal data shall be communicated to persons authorised to carry out the activities necessary for the execution of the contract entered into and shall be disclosed exclusively for this purpose. JURISDICTION AND COMPETENT COURT

Any dispute relating to the application, execution, interpretation and breach of the purchase contracts stipulated on-line through the website shall be subject to Italian jurisdiction. Any dispute between the parties with regard to this contract shall be submitted to the jurisdiction of the Court where the Customer has residence or domicile.
